NAIFA-Colorado Testifies for State-Run Health Insurance Program

On July 16th, NAIFA-Colorado State APIC Chair Kevin Ross testified before the Division of Insurance and the Department of Health Care Policy and Financing regarding a proposal to require state regulators to study the feasibility of establishing a state-run health insurance program.  NAIFA-Colorado commented that a state-run plan would lead to fewer carriers offering insurance coverage, potentially resulting in fewer options and higher premiums for consumers.  NAIFA-Colorado urged legislators to instead support proposals to ensure a vibrant and robust private insurance market.  NAIFA-Colorado further stated that the study must receive input from a wide variety of stakeholders so many views and opinions are considered.  After the testimony, NAIFA received support from industry partners and concerned citizens.

New York's 'Best Interest' Regulation Effective August 1 for Annuity Sales

The requirements of New York’s new “Best Interest” rule, Regulation 187, will be effective starting August 1, 2019 for annuity transactions, and will apply to life insurance sales starting February 1, 2020.  The rule puts in place a stringent “best interest” standard of conduct for producers and carriers in connection with annuity and life insurance sales and recommendations and will require agents and insurers to act in the best interest of the consumer when recommending a sales transaction. Producers will need to comply with the new requirements contained in the rule, and insurers will need to have various new processes and procedures in place to monitor and supervise producers’ compliance. The regulation’s requirements apply to recommended modifications to in-force contracts as well as to new policies.

Agents will also need to maintain documentation showing the basis for any recommendation and that the recommendation made was in the best interest of the client. Regulation 187 restricts a producer’s ability to use titles such as “financial planner” or “financial advisor” unless the producer “is properly certified and actually provides securities or other non-insurance financial services.” Unfortunately, the New York Department of Financial Services has not issued any guidance to help agents meet the requirements of this complicated new rule. NAIFA NYS has initiated a lawsuit challenging the validity of Regulation 187; that court case is still pending. NAIFA members are urged to follow any guidance/instructions they may receive from their insurers and/or broker-dealers concerning compliance with the new rule.
